TERMS OF SALE

This page tells you the legal terms and conditions (T&C’s) on which we sell any items on the site to you. Please note these T&C’s only apply to the purchase of Items on the site.

Please ensure to read these T&C’s carefully and make sure that you understand them before ordering any items from the sites. Before placing your order, you will be asked to agree to these Terms & Conditions by clicking on the button 'I Accept'. If you do not click on the button, you will not be able to complete your order. By agreeing to these Terms of Service, you represent that you are over 16 years.

You may only purchase from us if you are an authorised user of credit or debit card or payment account (ie Paypal) used to pay for your order.

You should print a copy of these T&C’s or save them to your computer for future reference.

These T&C’s can be amended from time to time. Every time you wish to order items, please check these T&C’s to ensure you understand the T&C’s which will apply at that time.

 

It is your responsibility to check regularly to see if any changes have been made to these Conditions. We reserve the right to modify or withdraw this Website at any time without liability to You. These T&C’s were most recently updated on 15th April 2024.

Our store is hosted on Wix. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

CONTRACT

​

The contract is formed between you and us through:

  • Our shopping pages will lead you through the steps needed to take to place an order with us. Our order process allows you to check and amend any errors before entering checkout;

  • Please take the time to check the details of your order at each stage of the order process and before clicking “Pay for My Order”, as you will not be able to make any changes to your order after this point;

  • After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted. Your order constitutes an offer to us to buy a product. All orders are subject to availability and acceptance by us.

  • We will confirm such acceptance to you by sending you an e-mail that confirms that the product has been dispatched. The contract between us will only be formed when we send you the dispatch confirmation.

We reserve the right to refuse an order for example if the Item you have ordered is unavailable or out of stock, if we are unable to obtain authorisation of payment, if there is an error in the product information including price, product quality or promotion or if we suspect fraudulent activity.

If we are unable to supply you with an Item in these circumstances, we will inform you of this by e-mail. If you have already paid for the Items, we will refund you the full amount including any delivery costs charged as soon as possible.

If you are contracting as a consumer, you may cancel a contract at any time within fourteen days, beginning on the day after you received the products. In this case, you will receive a full refund of the price paid for the products in accordance with our Returns Policy.

ITEMS ON WEBSITE

We provide second hand clothes; new, as new or in a re-sellable condition.

Images of the Items on the site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that your computer's display of the colours accurately reflects the colour of the Items. Your Items may vary slightly from those images. If a product offered by iSecondThat is not as described, your sole remedy is to return it in unused condition. See our Delivery and Returns Policy.

All sizes and measurements of Items are approximate; however, we do make every effort to ensure they are accurate as possible.

 

We take all reasonable care to ensure that all details, descriptions and prices of Items are as accurate as possible. We reserve the right to refuse orders where information about Items has been mis-published, including without limitation prices and promotions. We reserve the right to discontine any product at any time. 

These products or services may have limited quantities and are subject to return or exchange only according to our Return Policy.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer.

 

All descriptions of products or product pricing are subject to change at anytime without notice, at the sole discretion of us. Any offer for any product or service made on this site is void where prohibited. Prices for our products are subject to change without notice.
We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. If you are unhappy with your item please email our team with your order number and images with a brief description so we can look into this for you.

The price of an Item does not include delivery and returns charges. You will be provided with details of our delivery charges during the order process.

Our prices are set by a team who monitor market prices for the brands and styles that we sell. If the comparison price is an important factor in your purchasing decision, we recommend that you do your own comparison shopping as well.

Orders are placed solely through our website. Once you’ve added the product(s) you’d like to your basket, you’ll go through our checkout procedure where you’ll need to enter your contact details, delivery and billing information. Please check, double check and even triple check your order (e.g. the product(s), size(s) and delivery address) before clicking the “place order” button.

AUTHENTICITY

​

At iSecondThat we prohibit the sale of counterfeit items and comply with all applicable laws pertaining to counterfeit items. iSecondThat quality checks are in-house and independent and if we cannot verify the authenticity of an item or it does not meet the quality stands, it will not be listed regardless of it's condition. We reserve the right to destroy items that we deem to be counterfeit in accordance to applicable laws.

PRICE AND PAYMENTS

​

The price payable for the products shall be as shown on the iSecondThat Website in pounds sterling (GBP) but excludes delivery charges. Delivery charges are shown separately when ordering and must also be paid in advance. Delivery Charges are shown on our Delivery and Returns Policy.

Payment shall be made by you by the means specified on the website and shall not be deemed to be made until we have received cleared funds in respect of the full amount stated in the order.

Prices are subject to change without notice but changes will not affect orders which we have already accepted.


Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order) - this item will then be removed off sale for 24H.

Payment for all products must be by credit or debit card. We accept payment with Visa, Visa Debit, Mastercard. We also accept payments via PayPal.

 Only one voucher code can be used per order and additional terms and conditions may apply in respect of each voucher code. If you wish to apply a voucher code to your order, you must enter the relevant code during the online checkout process. We reserve the right to decline to accept any voucher code that is invalid for your order or that has expired.

All Items ordered remain our property until we receive full payment from you.

CLEAR OUT PACKS

​

Clear Out Pack Services are currently on hold - our courier service is currently not cost affective - we are accepting drop offs and are happy if you want to post your items through to us - please email customerservices@isecondthat.co.uk to find more information on this. 

​

Clothes MUST be in a re-sellable condition for example:

​

  • Fit to be worn buy someone else - ask yourself: "would you wear it and be happy to receive it"

  • No heavy damage (Frays in fabrics, no burn marks/marks that can't be removed, not soiled or bodily fluid stains)

  • Freshly cleaned, no stains & no defects

  • Odors removed

  • Any missing parts will cause the product to lose value but can be accepted (eg.dress with no belt)

All clothes will go through our CDQ checks(Condition, Defect and Quality checks) any items that do not pass our checks will be donated straight to charity.

​

BY SENDING CLOTHES YOU ACCEPT THESE TERMS:

  • You have accepted these terms and accept that we iSecondThat will be selling your items and have read the T&Cs as they tell and guide you about our services to you. 

  • You accept that we use our own discretion and in house 'CDQ' Condition, Defect and Quality checks to select items we deem fit for sale.

DELIVERIES 

​

All the information about our delivery charges can be found on the Delivery and Returns Policy.

​

From your order being placed - it can take upto 5 working days for your order to be processed before shipping out, this is to do final checks, we use Royal Mail whos delivery times can vary. If your order has not arrived within 2 weeks of ordering please email customerservices@isecondthat.co.uk with your order number for us to investigate.

​

You must provide us with complete and accurate delivery address information. For the avoidance of doubt, this includes not only the address that your order is going to but also the name of the recipient. We cannot be liable for any delays to your delivery or delivery of your order to the wrong address or the wrong person as a result of you supplying us with incomplete or inaccurate information.We will make every effort to deliver your order within estimated timescales. However, delays are occasionally inevitable due to unforeseen factors or events outside our control for example:

  • Travel and Transportation disruptions

  • Software or technical failures

  • Higher than anticipated demand

  • Strikes

  • Civil Riots, Invasions, Terrorist Attack or Threats, War (whether declared or not) 

  • Fire, Explosions, Storm, Floods, Earthquakes, Epidemics, or other natural disasters

  • Impossibility to use transport methods

Please note delivery of your order may take longer during sale or other busy periods.

​

We deliver the products to you will depend on the delivery method you select during the order process, please refer to our delivery timings on our Delivery and Returns Policy. If you are buying products during promotional periods, it may take a little longer for our products to be delivered to you.

​

We are unable to deliver on public and bank holidays, Christmas Day, Boxing Day or New Year’s Day. On these dates, delivery will take longer than usual. Please allow an extra working day (i.e. Monday-Friday, excluding Saturdays, Sundays and public holidays) for each of these days when calculating the estimated delivery date and when choosing your delivery option.

If delivery of the products to you is delayed by an event outside our control (e.g. because of postal/courier delays, logistics or bad weather), we’ll let you know as soon as possible. If there is a risk of substantial delay, you can contact us to cancel your order and we’ll refund you for any products you’ve paid for but not received.

​

If no one is able to take delivery and the products cannot be posted through your letterbox, the courier will notify you of the delivery attempt and tell you how to rearrange delivery or collection of the products.

 

You must inspect the items on delivery, If you identify any major damages or shortages that are not listed on the site, you must inform us in writing within 7 days of they delivery, providing details of issues.

​

 We will be under no liability or further obligation in relation to the Goods if:
a. if you fail to provide notice as set above; and/or
b. you make any further use of such Goods after giving notice under the clause above relating to damages and shortages; and/or
c. the defect arises because you did not follow our oral or written instructions about the storage, commissioning, installation, use and maintenance of the Goods; and/or
d. the defect arises from normal wear and tear of the Goods; and/or
the defect arises from misuse or alteration of the Goods, negligence, wilful damage or
e. any other act by you, your employees or agents or any third parties.

RETURNS AND YOUR RIGHTS

​

If you want to end the contract because of one of the reasons below, the contract will end immediately, we will refund you in full for any products which you have paid for but which have not been supplied to you. The reasons are:

  • We have notified you about an error in the price or description of the product you have ordered, and you do no wish to proceed;

  • We have notified you about the supply of your products may be significantly delayed because of events outside our control;

  • You have the legal right to end the contract because of something we have done wrong

If you are a consumer in the European Economic Area (“EEA”), you have a legal right to cancel a Contract if you change your mind until 14 days after you receive (or someone you nominate receives) the Products, unless the Products are split into several deliveries over different days in which case you will have until 14 days after the day you receive (or someone you nominate receives) the last delivery.

​

If you wish to cancel a Contract you just need to communicate this to us within the timescale set. The easiest way to do this is to contact us by email at customerservice.isecondthat@gmail.com or by post at Aston Common Farm, Aston Common, Sheffield S26 2AE.

If you cancel a Contract after the Products have been dispatched to you, you must return them to us. You must send off the Products within 14 days of telling us that you wish to cancel the Contract.  Please see our Returns Policy for further information about how to return Products to us.

​

You must take reasonable care of the items. Whilst you may inspect the Items when they are in your possession you must not use them. Returns must have tags still attached.

​

We offer a goodwill guarantee which gives you 20 days to change your mind and receive a refund instead of the standard 14 days (which does not affect your legal rights in relation to faulty products). You have 20 days from the day you (or someone you nominate) receives the products to change your mind. If your products are split into several deliveries over different days, you have until 20 days after the day you (or someone you nominate) receives the last delivery to change your mind. In either case, you will need to pay the cost of the return as set out in our Returns Policy.

Please note that some products can’t be returned, such as:

​

  • Jewellery

  • Any product which has been damaged, worn, used in any way, is not in it's original sold condition, care label removed or our swing tickets removed.

  • Products that are missing any component part(s) when returned. (Unless this was stated as missing during sale)

​

Once your return is received, we will send you an email to notify you that we have received your returned item. Once your item has been inspected, we will notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed.

We will refund you the price you paid for the products by the method you used for payment.  You are responsible for the cost of sending your parcel back. If you used a discount code to buy the product, the amount refunded will be reduced to take into account the benefit of any discount which you received when buying the product. We will make any refunds due to you as soon as possible. If you are exercising your right to change your mind, your refund will be made within 14 days from the day we receive the unused product back from you.

DISCOUNTS AND CODES

​

To claim your discount/codes, simply go to your 'Bag' section of your account there is an option to “Apply Coupon”, which allows you to enter the promotional code in order to apply it to the order.

Discount Codes can only be used once per customer, cannot be used in conjunction with any other promotion or offer, remain our property and are not transferable. There is no cash alternative.

Discount Codes can only be used on full priced items. Discount Codes are not valid on sale items, markdown items.

CLIENT TERMS & CONDITIONS

Clients can claim store credit from sales or donate to a charity of their choice

 

INSPECTION PROCESS

​

iSecondThat have a thorough CDQ Inspection (Condition, Defects, Quality). When clothes arrive they are unpacked and will go through the CDQ Inspection, this is then repeated by another team member to make sure that  no errors are missed. Following this any items that have not been accepted and the client has not requested or paid for an Auto Return, will be donated to a local charity of our choice.

We want to make sure you have had a easy experience however we understand that sometimes things can go wrong, or you may have questions you want answering:

DATA PROTECTION

 

When providing the Goods to the Buyer, the Seller may gain access to and/or acquire the ability to transfer, store or process personal data of employees of the Buyer.

The parties agree that where such processing of personal data takes place, the Buyer shall be ‘data controller’ and the Seller shall be the ‘data processor’ as defined in the General Data Protection Regulation (GDPR) as may be amended, extended and/or re-enacted from time to

For the avoidance of doubt, ‘Personal Data’, ‘Processing’, ‘Data Controller’, ‘Data Processor’ and ‘Data Subject’ shall have the same meaning as in the GDPR.

The Seller shall only Process Personal Data to the extent reasonably required to enable it to provide the Goods as mentioned in these terms and conditions or as requested by and agreed with the Buyer, shall not retain any Personal Data longer than necessary for the Processing and refrain from Processing any Personal Data for its own or for any third party’s purposes.

The Seller shall not disclose Personal Data to any third parties other than employees, directors, agents, subcontractors or advisors on a strict “need-to-know” basis and only under the same (or more extensive) conditions as set out in these terms and conditions or to the extent required by applicable legislation and/or regulations.

The Seller shall implement and maintain technical and organisational security measures as are required to protect Personal Data Processed by the Seller on behalf of the Buyer.
